I am excited to announce the publication of this Academic Forum on ISDS Concept Paper, co-authored with Joshua Paine and Catharine Titi. Our paper examines the scope of UNCITRAL: United Nations Commission on International Trade Law Working Group III's mandate when reforms cover both procedural and substantive elements of ISDS. A new Academic Forum on ISDS Concept Paper, authored by Joshua Paine, Edward Guntrip, and Catharine Titi, entitled "The Intersection of Substance and Procedure in the Work of #UNCITRAL Working Group III: The Questions of #Damages, the Right to Regulate, and Counterclaims" has just been published online. The Paper reflects upon the Working Group III (WGIII)'s mandate and examines how it has been applied to topics that span procedural and substantive aspects of investor-state dispute settlement (#ISDS). It concludes that the degree to which substantive aspects of ISDS can be included within WGIII's remit is context dependent and ultimately subject to state consent.
