Digital health care companies have navigated a wave of new developments at the Federal Trade Commission (FTC) over the past few years. With new leadership in the Trump Administration, the FTC may be poised to change some of its approach to digital health issues, though many critical compliance issues involving privacy, security, and advertising are likely to remain unchanged. This week in our March Privacy Forecast, we are discussing a significant outlier amongst U.S. state privacy laws: the Maryland Online Data Privacy Act (MODPA), which is set to take effect on October 1, 2025. ? With 13 comprehensive state privacy laws already in effect, the state privacy law landscape is complex. While there are several common threads throughout many of these frameworks that can allow companies to implement a universal compliance strategy, each state comprehensive privacy law in effect has unique nuances that companies must account for. The new Maryland law compounds these complexities, and companies subject to MODPA will face additional operational challenges in implementing several of the new law’s provisions, which significantly depart from other privacy laws.??????? ? The California Consumer Privacy Protection Agency (CPPA or Agency) announced a settlement with an auto manufacturer, marking the Agency’s first enforcement action under the California Consumer Privacy Act (CCPA or Act), which has to date only been enforced by the California Attorney General. While the settlement followed the CPPA’s connected car investigative sweep announced in July 2023, the Agency’s allegations are not specific to the automotive industry, and instead should be viewed as instructive for any business subject to California’s broad and prescriptive CCPA and implementing regulations. ? The FCC issued a Public Notice titled “In Re: Delete, Delete, Delete,” which seeks public comment on “identifying FCC rules for the purpose of alleviating unnecessary regulatory burdens.” Touted by FCC Chairman Brendan Carr as a “sweeping deregulation initiative,” the Public Notice follows President Trump’s February 19 Executive Order (EO) titled “Ensuring Lawful Governance and Implementing the President’s ‘Department of Government Efficiency’ Deregulatory Initiative.” The Public Notice kicks off a broad proceeding pursuant to the EO that subjects all FCC regulations to potential elimination or change.
