A new state toolkit prepared by Manatt Health’s Patricia Boozang, Eric Gold and Michelle Savuto with support from the RWJF’s State Health & Value Strategies program provides support to states for regulating #financialization in the health care system. The toolkit is intended to help states understand the landscape of financial activity and identifies opportunities to strengthen their regulatory frameworks to protect residents from the potential harms associated with financialization. It also describes recent federal action taken to study and regulate such activity while highlighting recommendations and best practices. A Manatt #probono team, in partnership with Harvard Law School Center for Health Law and Policy Innovation, filed an amicus brief in a case before the U.S. Supreme Court on behalf of several organizations representing people with chronic illness or disabilities in Kennedy v. Braidwood Management, Inc. The team included Michael Kolber, Benjamin Shatz and Shannon Gonick. The brief argues that the people often forgo evidence-based preventive services when there is a cost attached and that a uniform federal requirement for no-cost preventive services ensures the entire health care system aligns around covering services that prevent chronic illness and disability, and reduce health care expenses. While no one knows exactly how budget debates will unfold in Congress in 2025, one thing is clear — #Medicaid is positioned as a key source of budget cuts. Of the $2.5 trillion the new administration wants to cut from the federal budget, $880 billion and counting is expected to come from Medicaid, a 10% reduction in federal funding over the next decade. To hit these targets, Congress likely will need to pursue a per-capita cap or elimination of enhanced funding for the 19 million adults covered via the Affordable Care Act’s expansion of Medicaid. While it is tempting to ignore the ins and outs of the reconciliation process, it will dictate the future of Medicaid as key decisions are made. A new white paper prepared by Manatt Health's Jocelyn Guyer and Ashley Traube, with support from Foundation for Opioid Response Efforts (FORE), highlights ways states can leverage existing authorities under #Medicaid and #CHIP to sustain innovative prevention programs that support and treat children and families impacted by opioid and other substance use disorders. The authors looked at how seven FORE grantees could leverage state plans, waivers and other authorities to cover evidence-based prevention, treatment and case management services, as well as provider training. As the GOP eyes cutting up to $2.5 trillion of the federal budget, one under-the-radar health care cut could threaten #Medicaid program integrity, efficiency, and innovation – and potentially unwind many state #healthdata ecosystems. ? In our latest article from The 80 Million, Manatt Health’s?Kevin McAvey warns that the GOP proposal to cap federal Medicaid Admin Claiming match rates at 50% could result in state #HIT costs increasing from 100% to 400% for some core enterprise and #healthtech investments. CMS currently reimburses Medicaid programs for their technology and systems – from infrastructure to support eligibility determination and claims payments to fraud control and program impact monitoring – at rates varying from 50% to 100% and totaling over $35 billion annually. ? Capping rates might seem like an easy, modest line to draw but would limit states’ ability to invest in more efficient programs, improve operational integrity, and leverage new technologies to support innovation that has the potential to make Medicaid more effective and cost less – which is at odds with the new administration’s goals of advancing a more effective and efficient health care delivery system. ? A new white paper identifies key barriers for access to cell and gene therapies (CGTs) in the Medicaid program, as well as policy solutions to address those barriers at the state and federal levels. Although leading scientists have developed a growing number of CGTs for serious and life-threatening diseases, these breakthroughs are not accessible to all.
