The Council of School Attorneys (COSA) supports attorneys representing K-12 public school districts and state school boards associations. The work of the Council is widely respected and a resource for school board attorneys and state association counsel across the country. COSA provides a national forum for the discussion of legal issues and problems encountered by school attorneys in providing legal counsel, advice, and representation to public school boards and state school boards associations. It also promotes and helps develop a closer relationship and better understanding between school attorneys and their clients, school boards, and school boards associations.

    Based on the U.S. Supreme Court ruling in Muldrow v. City of St. Louis, school systems may now need to consider the possibility of a discrimination claim before involuntarily transferring an employee.     Effective July 1, 2024, new provisions will apply to school lunch and breakfast programs under the U.S. Department of Agriculture’s Food and Nutrition Service final rule. This rulemaking gradually phases in added sugars limits for the school lunch and breakfast programs and updates total sugars limits for breakfast cereals and yogurt to added sugars limits.     The?U.S. Department of Labor announced?a?final rule?that expands overtime protections?for lower-paid salaried workers by increasing the salary thresholds required to exempt a salaried bona fide executive, administrative, or professional employee from federal overtime pay requirements.?While teachers and school administrators are exempt from the rule, it does raise the minimum salary threshold for non-teaching worker exemptions.     The U.S. Department of Education recently released its Final Rule under Title IX, which prohibits discrimination on the basis of sex in education programs or activities receiving federal financial assistance. The rule marks a shift in policy and approach from the final rule issued in 2020 in several key ways, including expansion of the scope of discrimination based on sex to include not only discrimination based on sex stereotypes, sex characteristics, and pregnancy or related conditions, but also (for the first time) sexual orientation and gender identity.
