However, in many cases, victims face various hurdles and challenges when trying to register a complaint. To address this issue and ensure the prompt registration of cases, the concept of 'Zero FIR' was introduced in India. In this article, we will explore the meaning, benefits, and legal implications of Zero FIR, along with notable cases and legal facts.

Meaning and Concept of Zero FIR

The term 'Zero FIR' is derived from the fact that it does not bear any FIR number at the time of registration. The Zero FIR system allows victims to report a crime at any police station, regardless of jurisdiction, irrespective of where the incident occurred. The FIR is later transferred to the appropriate police station having jurisdiction over the case. This concept was introduced by the Indian police as a mechanism to ensure that no time is wasted in registering a complaint, particularly in cases when an immediate and urgent response is needed.

Legal Provision for Zero FIR

The legal provision for Zero FIR is provided under Section 154 of the Code of Criminal Procedure (CrPC) 1973. According to this section, any police officer, on receipt of information regarding the commission of a cognizable offence, is bound to register an FIR. This provision grants the police the authority to register a complaint and initiate an investigation, regardless of jurisdiction. It ensures that no complaint goes unattended or is refused to be registered due to territorial limitations.

Nirbhaya Case:?

The infamous Nirbhaya gang rape case in Delhi in 2012 brought the concept of Zero FIR into the limelight. The victim's friend immediately reported the incident to the police, who registered a Zero FIR. The case was later transferred to the appropriate police station for further investigation.

Bhanwari Devi Case:

?In the Bhanwari Devi case, a nurse was abducted and murdered in Rajasthan in 2011. Her husband registered a complaint at a police station in Jodhpur, which registered a Zero FIR. The case was subsequently transferred to the CBI for further investigation.

The victim or informant must provide a detailed account of the incident, including all relevant information such as date, time, place, and persons involved.

Complaint registration:?

?The police officer receiving the complaint must record the complaint in the General Diary and issue a receipt to the informant. The complaint is then treated as a Zero FIR.

Transfer of FIR:?

The Zero FIR is subsequently transferred to the appropriate police station having territorial jurisdiction over the offence.

Challenges and Limitations of Zero FIR

Lack of awareness:?

Many people are not aware of the concept of Zero FIR, which leads to under utilisation of this valuable tool. There is a need for public awareness campaigns to educate people about their rights and options while reporting a crime.

Delay in transferring FIR:?

In some cases, there may be a delay in transferring the Zero FIR to the appropriate police station. This delay can hinder the timely investigation and processing of the case.

Burden on police stations:?

The concept of Zero FIR places an additional burden on police stations, as they have to handle cases that are not within their jurisdiction. This can result in increased workload and delays in investigation.

Inconsistent implementation:?

The implementation of Zero FIR varies across different states and police jurisdictions. There is a need for consistent implementation and better coordination among police stations to ensure the effectiveness of this concept.
