Your Path to Spanish Residency: Navigating the Process with Confidence

Are you planning to make Spain your permanent home or thinking about relocating to this vibrant country? If you intend to stay in Spain for more than 90 days within a 180-day period, you will need to become a legal resident. Understanding the New Rules for Travel and Work in Spain

Since January 1, 2021, the rules for traveling and working in European countries, including Spain, have changed. Travelers can now stay in Schengen area countries for up to 90 days within any 180-day period without a visa. However, at Spanish border control, you may be required to show a return or onward ticket and prove you have sufficient funds for your stay. Your passport will also be stamped with an entry date.

If you plan to stay in Spain for more than three months, you must apply for residency. For stays exceeding six months, you will be classified as a tax resident and will need to pay taxes on your worldwide income. The process of becoming a legal resident involves obtaining a TIE card, which requires two main steps:

Obtain a visa from the Spanish consulate in the UK.

Complete your TIE card application once you arrive in Spain.

Step 1: Application for NIE

If you are a non-resident in Spain, obtaining an NIE number (Número de Identificación de Extranjero) is mandatory. This number is essential for carrying out any transactions in Spain. You can apply for an NIE at the National Police Station, and you will need to return approximately three days later to collect it. Initially, you will receive a temporary certificate valid for three months. Although your NIE number will not change, you will need to apply for a new certificate after three months.

Step 2: Open a Spanish Bank Account

Having a local bank account in Spain is crucial for managing your finances and making necessary payments related to your residency process.

Step 3:

Your chosen lawyer will request a power of attorney to be signed in the UK. They will need a scanned copy of your passport, postal address, marital status, and profession to prepare this document.

Step 4: Apply for Your TIE Card in Spain

Once you have obtained your visa, the next step is to apply for your TIE card in Spain, which formalizes your residency status.

Relocating to Spain as a Self-Employed Individual

If you are relocating to Spain to become self-employed, you will need to complete two separate procedures: applying for a work permit and then for a visa. Here are the steps and requirements for each process:

A. Requirements for the Work Permit

Legalized copy of your passport.

Police clearance from countries of residence for the past five years.

Medical certificate confirming you do not suffer from any diseases listed under the International Health Regulations 2005.

EX 07 Form – application for a temporary residence permit for self-employment.

Certification or accreditation of skills required for your profession, if applicable, and duly legalized.

Proof of financial investment needed to implement your project.

Detailed project plan outlining the investment, expected profits, and potential job creation.

References or authorizations required for the installation, opening, and operation of your proposed activity, including the certification of applications to relevant agencies.

Payment of fees for the Temporary Residence Permit Self-Employed (Form EX 790-062) if the Autonomous Community does not have the competence transferred.

The above documentation must be submitted to the relevant authorities in Spain in the province where you intend to work and reside. If your application is approved, you will be notified and must apply for your visa in person at the Consulate within one month.

B. Requirements for Visa Applications

Two completed and signed National Visa Application forms.

Two recent color photos with a white background (3.5 cm x 4.5 cm).

Original passport and a copy, valid for at least four months from the date of application.

Police clearance from countries of residence for the past five years.

Medical certificate confirming you do not suffer from any diseases listed under the International Health Regulations 2005.

Copy of the residence and work authorization notification, along with proof of payment for the residence permit and self-employment authorization (Form EX07 and 790-062).

The visa application process can take up to three months. If your visa is granted, you must collect it in person from the Consulate General within one month of notification. Upon entering Spain, make sure your passport is stamped at the port of entry. Within one month of entry, you must apply for a foreign identity card at the Oficina de Extranjería.
