Your Choice of Lawyer Can Have Long-Term Consequences (Good and Bad)

I always try to get inside the minds of my litigation opponents to drive trial strategy and successful results. And I know that other good attorneys do the same thing.

?

But sometimes, there isn’t a good explanation for the other side’s maneuvers—just missteps. What I’ve come to realize is that we lawyers have a front row seat for the warning signs when someone has hired the wrong attorney.

?

I believe that we should share this with our clients. Because sometimes you won’t be the ONE representing your client (whether due to expertise, conflicts and/or jurisdiction).

?

Bad work and missed deadlines are obvious warning signs.

?

But one that’s not so obvious is when strategy doesn’t align with the business needs or documentation.

?

For example, sometimes attorney’s hyper-focus on an argument to make in the moment that might give them extra time (and a perceived short-term win) but that could have unintended negative long-term consequences to their case and even their clients’ business.

?

A litigation ‘win’ should save and protect the client’s property, money AND business.

?

That is always my goal (and should be your attorneys’ goal too).
