Red Sea & Gulf of Aden: using BIMCO’s VOYWAR and CONWARTIME clauses
In light of the recent development, BIMCO recommends using the latest editions of its War Risks clauses: BIMCO War Risks Clause for Voyage Chartering 2013 (VOYWAR 2013) and BIMCO War Risks Clause for Time Chartering 2013 (CONWARTIME 2013). These clauses contain a broad definition of “War Risks” that include warlike operations and hostilities that do not require a declaration of war by states.??

BIMCO adopts portfolio of four ETS clauses
BIMCO’s Documentary Committee has adopted a new Emission Trading Scheme Allowances Clause for BIMCO’s ship management agreement, SHIPMAN, and three ETS clauses for Voyage Charter Parties.
On 1 January 2024, the EU Emissions Trading System (EU ETS) will be extended to cover CO2 emissions from ships of 5,000 GT and above calling EU ports, regardless of flag. Ships engaged in voyages between two EU ports, and voyages between the EU and a third country, will be covered by the EU ETS.
BIMCO’s new ETS clauses have been developed for use with any applicable emission scheme, including, but not limited to, the EU ETS. This has been done to ensure that the clause can be used with other schemes that may come into force in the future.

IMO Maritime Single Windows: BIMCO survey reveals demand for standardised solutions
From 1 January 2024, ports and authorities around the world will need to follow new requirements from the IMO to use a “single window” platform to exchange data electronically.

Nigerian piracy: A thing of the past?
As 2023 draws to a close, it seems appropriate to take stock of the Nigerian piracy situation. In 2023 to date (14 December) three pirate attacks against seagoing ships have been recorded, and two of these attacks were successful. One of the successful attacks was related to cargo theft related, and one was related to kidnap for ransom.
These statistics are a striking contrast to the situation only a few years ago were Nigerian kidnap for ransom spread fear among seafarers off Nigeria and was regarded the number one security issue for the international shipping industry.
