Frequently Asked Questions

Q: Some of my client’s don’t want to appoint CTTC Ltd as their Executors preferring to appoint family or friends, what can I advise?

A: Firstly, it’s always the client’s choice who they appoint however, many people just don’t understand how complex and time consuming managing Probate can be. Not only will those appointed have to undertake this at what can be already be a very difficult time for them and have to deal with any added stress arising from any disputes between relatives and other Beneficiaries, but the process carries some personal legal liability. There can be many pitfalls along the way for those not professionally qualified to deal with the legal process of Probate.

Q: So, am I correct in assuming that CTTC Ltd can only undertake Probate where they have already been named as Executors in the Will?

A: No. CTTC Ltd can be appointed as Professional Executors after the client has died by the existing Executor(s) and so you would still benefit from the same % of the fee charged. When you are informed that a client or someone you know has passed away, then this is your opportunity to introduce them to CTTC Ltd for all of the reasons in the “benefits to your clients” listed above. 

Q: Some of my clients still insist on appointing family or friends, I am concerned that I will not get to know when they have passed away and so will lose out.

A: Clients don’t always follow best advice but we can ensure that CTTC Ltd know when a client has passed away by recommending that your clients store their Wills and other legal documents. Then when we are contacted by the Executors to request the release of the Will we can talk to them about the benefits of using CTTC Ltd as Professional Executors, so ensuring that you still benefit from your share of the Probate fees, any investment business sales opportunities and access to the deceased client’s family. I used to work for HSBCs Probate Department, so know a little! My main issue was with your statement of 3/5% plus hourly rate charged by solicitors. Now, I'm not a solicitor but work for one, and I know fees on that scale simply don't exist. I also have an issue with the 'problem' of hourly rates. If estimated correctly, they are not the step into the unknown many suggest they are. Rarely do I need to revise my hourly rate quotes when instructed by lay exits because I know what I'm doing. Besides, % only fees don't necessarily reflect the work involved e.g: 200k in two bank accounts....kerching! Having said that, I have offered fees based on Fixed fees, %, or hourly rates. Flexibility is key.
