The High Court has ruled that 4 pubs owners who took action against FBD Insures for their failure to compensate the pub owners for the losses caused by the pandemic are entitled to be compensated by FBD for the disruption their businesses suffered due to Covid 19.
So What?
This decision is a landmark decision that will have a knock-on impact for thousands of businesses across Ireland and possibly including yours. Many businesses are finding themselves in a position where their Insurance providers are not compensating them for losses and disruption caused by the pandemic despite the fact that there is a business interruption clause within the policy.
So what does this mean for your business?
The decision, while very welcome is not a blanket order for insurers to pay out on business interruption claims. Ultimately it will be the wording of the policy that decides whether you have a valid claim or not.
