Will You be Cheated out of Overtime Pay?

That is the charge made Democrats after the House passed the  Working Families Flexibility Act of 2017. The bill would allow employers to compensate their workers with additional paid time off rather than pay them for their overtime pay. In effect, it gives employers control on whether they have to pay their workers time-and-a-half for overtime. Senator Elizabeth Warren called the bill a "589 page insult to working families." The White House indicated that the president will sign the bill if it passes the Senate where it must get a 60 vote majority. I don't think this will affect unionized employees who will continue to receive overtime pay if it is considered in their labor contract. But I wonder how this will impact employees working in states where their state and local laws govern overtime pay. What do you think?

This non-partisan article by the Society for Human Resource Management, states that while it appears on the surface that employees are now provided with a coersion-free choice, Rep. Bobby Scott, D-Va., the committee's highest-ranking Democrat, said that although the law currently allows public-sector employers to substitute comp time for overtime pay, government entities "don't have the same incentive to underpay workers that the private sector has." https://www.shrm.org/ResourcesAndTools/hr-topics/compensation/Pages/Comp-Time-Bill-Faces-Senate-Fight.aspx As with most legislation, depending on who is in charge, it can be implemented either way. It is up to employees/voters to stay informed, ask relevant questions and vote accordingly
