WORRIED ABOUT LAND EXPROPRIATION?

As the world moves toward normality after the repercussions caused by COVID-19, Parliament has now continued with the process of implementing land expropriation without compensation. On 9 October 2020, the Expropriation Bill (“the Bill”) was gazetted.
It is safe to say that not all land will be at risk of being expropriated without compensation. Section 12 of the Bill deals with how compensation will be determined. More specifically, section 12 (3) of the Bill sets out instances where it may be just and equitable for nil compensation to be paid.
One of these instances is where land is not being used and the owner’s main purpose is not to develop the land or use it to generate income, but to benefit from appreciation of its market value.
