Working rights for students and graduates

Hy everyone!??

We have been talking a lot about some difficulties for students and graduates due to Australia's labour shortage and COVID restrictions. ??

Because of a lot of contradictory information, many people asked me to clarify this subject. ??

?In this post, I decided to dispel your doubts and make the situation more transparent. ??

Let's talk today about graduates' and students' rights and current exceptions, which could significantly increase the opportunity for students and graduates to find a good job, gain local experience and earn good money. ??

??Student working rights

??The following standard requirements apply to student visa holders:

① Do not work before the course starts;

② College students and bachelors can work no more than 40 hours in a fortnight (part time) + no restrictions during holidays.

For their partners/spouses (second applicants) - no more than 40 hours in a fortnight.

③ Masters can work no more than 40 hours in a fortnight (part time) + no restrictions during holidays.

For their partners/spouses (second applicants) – no restrictions.

④ PhD and their partners/spouses (second applicants), working rights are not limited.

??Temporary Exceptions for student visa holders

① Until June 30, 2023, all current students and arrived students and applicants, can work more than 40 hours in two weeks in any sector of the economy;

② Students can arrive in Australia up to 90 days before the course begins and start work before the start of the course;

③ After June 30, 2023, working hours may be limited again.

??Student obligations

?? All students, despite the work rights and restrictions, must comply with the basic visa requirements:

? Maintain their course enrolment

? Ensure satisfactory course attendance,?and

? Ensure satisfactory course progress.

?

??Working rights for graduates

① For graduates and second applicants of the Graduate Work stream - full working rights for up to 18 months. Skills assessment in MLTSSL occupation, an English exam and a completed Australian education of at least 92 weeks is required for the main applicant in a related occupation. ? Visa holders can run their own business.

② For graduates and dependent visa holders of the Post-Study Work stream - full working rights for a period of 2 to 4 years, depending on the degree:

? Bachelor including Bachelor with honors – 2 years;

? Master by Research and Master by Coursework – 3 years;

? PhD and doctors – 4 years;

? Hong Kong or UK passport holders - 5 years for any degree.

??There is an opportunity to extend the Post-Study Work stream graduate visa for applicants who are living and studying in regional Australia: for zone 2 - 1 additional year, for zone 3 - 2 additional years.

? Visa holders can run their own business.

? It is mandatory to complete the educational course and pass English exam.

?

??Temporary exceptions for graduates?

① For Graduate Work stream visa holders who applied after December 1, 2021, the visa validity period has been extended up to 24 months.

If the application is submitted between July 1, 2022 and June 30, 2023, it is not required to provide skills assessment for occupation from the MLTSSL.

② Post-Study Work stream graduate visa holders of selected degrees in areas of skill shortages visa duration will be increased from:

? Two years to four years for selected Bachelor’s degrees;

? Three years to five years for selected Masters degrees;

? Four years to six years for selected PhDs.


??Graduates obligations:

? All graduates must have valid health insurance for themselves and dependent applicants;

? If your visa was extended because of your regional location, you have to live, work and study in the Designated regional areas of Australia.
