Amazingly it is already August, and we find ourselves at the back end of summer.?There is so much to do in WNY during this time of year, from the summer concerts and County Fairs to the buzz around the Bills Training Camp in Rochester. With all that is going on, we sincerely hope you find our quick, monthly e-newsletters to be an effortless way to assist you in keeping up with everything that is happening in the HR world. ?
- Employers across the country are awaiting the final U.S. District Court decision regarding the Federal Trade Commission’s (FTC) final rule on most non-compete agreements.?On July 3rd, the U.S. District Court for the Northern District of Texas granted a preliminary injunction and postponed the effective date for the organizations that sued to block.?The court also has said that they will rule on the merits of the rule on/before August 30th, which would be prior to the September 4th effective date.
- We are starting to see consultant projections regarding items such as what pay increases will look like in 2025.?The general early consensus is for salary increases to be in the 3.5-4% range for next year.?This is a smaller number than 2024 at 4.1% and 2023 at 4.5%.
- The National Labor Relations Board (NLRB) has decided to abandon the implementation of its 2023 joint employer rule.?That rule was struck down earlier this year by a federal district court.?The court determined that the rule was too broad and virtually every third-party labor agreement would become a joint employer situation.
- The E-Verify system is getting a makeover with the trial launch of E-Verify+.?The U.S. Citizenship and Immigration Services (USCIS) has announced that they are starting to roll the system out on a trial basis with the largest change being a move towards new hire self-service. For example, new hires will electronically enter biographical details, citizenship or immigration status, and appropriate identity document information into their account. The employer is then alerted that the new hire piece is complete, and they will examine the submitted documents and complete the I-9 for downloading and storage.?Furthermore, in E-Verify+, a worker’s information will be stored and can be transferred for usage if they change jobs and need to be verified again. E-Verify is required to be used for federal contractors and is currently voluntary for others in New York state.
- Employment-based immigration is a planned focus of the White House for the 2nd half of 2024.?The month of December is the slated publication date for a final rule that will overhaul the H-1B program.?Amongst the expected H1-B Visa changes, will be revising the educational eligibility criteria and addressing the suspected fraud in the cap registration process.?On the H-2 side, there is expected to be a new regulation in November that will add whistleblower protections and expanded grace periods for workers on this visa and in danger of losing their employment.
- In a related note, the U.S. Department of Customs and Border Protection (CBP) recently proposed a new rule that will expand the number of employers required to pay the 9-11 Response and Biometric Entry/Exit Fee when petitioning for H-1B and L-1 visa extensions.?The additional fee would run $4,000+ dollars and apply to companies with 50 or more employees that have more than 50% of their U.S. employees on one of these two visa programs.
- A growing concern for job seekers (and therefore employers) is the resurgence of job posting scams.?The FTC reported over 75,000 claims of job and business opportunity fraud in just the first three quarters of 2023.?The goal of these fraudsters is to use the national employment sites, such as Indeed and LinkedIn, to trick job seekers into sharing their personal information with them.? A great solution to combat this growing threat is for employers to use a local employment source that personally reviews and screens all new postings…WNYJOBS.com. By using a local company, there is much less anonymity for the scam poster.
