NO WITNESS, NO EVIDENCE, BUT JURY DECIDES THAT BUS KILLED PEDESTRIAN -- AND APPEALS COURT AFFIRMS
Lawrence Rogak
Philosopher/ lawyer who wrote the book on New York PIP. No artificial intelligence, ever.
In today's Rogak Report:
A woman was found crushed to death near a bus stop. Neither the driver, nor the passengers, saw or heard anything, and there were no other witnesses. Based only on the theory of an expert who looked at the scene 6 years later, that had no evidence to back it up, a Bronx jury found the Transit Authority negligent --- and the Appellate Division affirmed (with a scathing dissent).
