Why Embracing EDR Can Boost Your Success

Why Embracing EDR Can Boost Your Success

First, I want to highlight a significant accomplishment on the part of some valued colleagues. Yesterday, the House of Delegates of the American Bar Association unanimously approved Resolution 500 promoting the use of early dispute resolution. This resolution was put forth by the ABA Section of Dispute Resolution and in particular represents two years of hard work and passion on the part of Ellie K. Vilendrer , Mary Cullen and Felicia Harris Hoss, FCIArb supported by our Section Chair, Ana Sambold, Esq. and House of Delegates Representatives James Alfini and David Allen Larson . This resolution, and it's unanimous adoption, is indicative of the rise of, and trend toward, early dispute resolution.

Now I want to dive into why this is a significant issue and should be on your radar for your dispute resolution practice. Take note of the interest in EDR because it represents an OPPORTUNITY for your practice! Let's take a deeper look at why you might consider offering early dispute resolution services in your practice.

At the outset, it is important to remember that mediation isn't just for when things are on the brink of collapse. Early Dispute Resolution (EDR) is gaining traction as a proactive approach because it saves time, costs, and relationships for your clients. Offering EDR services can not only benefit your practice but also position you as a thought leader in the field.

EDR offers significant benefits for clients:

  • Faster resolution: Addressing issues early prevents them from festering and escalating into costly lawsuits.
  • Reduced costs: Mediation is significantly cheaper than litigation, saving clients financial resources.
  • Preserved relationships: EDR fosters respectful communication and collaboration, potentially salvaging important business or personal relationships.
  • Win-win solutions: Collaborative problem-solving often leads to mutually beneficial outcomes, unlike the "winner-takes-all" mentality of litigation.

How you can boost your practice with EDR:

  • Attract new clients: Businesses and individuals increasingly seek proactive solutions to manage conflict. Showcasing your expertise in EDR positions you as a valuable resource.
  • Expand your service offerings: EDR complements your existing mediation practice, offering clients a wider range of conflict resolution options.
  • Increase client satisfaction: Happy clients who experience the benefits of EDR are more likely to recommend you and return for future needs.
  • Enhance your reputation: Proactive engagement in the growing EDR trend demonstrates your commitment to innovative and effective conflict resolution techniques.

The unanimous ABA resolution is a powerful endorsement of EDR's growing importance, and it's time to turn opportunity into action. By incorporating EDR into your practice, you're not just offering an additional service, you're empowering your clients to proactively manage conflict, preserve relationships, and achieve mutually beneficial outcomes.

Here's how to get started:

  • Educate yourself: Take continuing education courses, attend webinars, and explore resources from the ABA Section of Dispute Resolution.
  • Network with colleagues: Connect with other EDR practitioners to share best practices and build your referral network.
  • Market your expertise: Update your website, social media profiles, and marketing materials to highlight your EDR services.
  • Offer free consultations: Let potential clients experience the value of EDR firsthand.
  • Stay informed: Keep up with the latest trends and developments in the EDR field.

By embracing EDR, you're not just expanding your practice, you're shaping the future of conflict resolution, one successful case at a time. Be the trusted advisor clients turn to for navigating conflict constructively and paving the way for positive outcomes.

Additional Tips:

  • Consider mentioning specific types of EDR services you offer (e.g., facilitations, mediations, arbitrations).
  • Share a success story or client testimonial showcasing the benefits of EDR.
  • Include a call to action, encouraging readers to contact you for a consultation or further information.

Remember, you have the power to make a difference in your clients' lives by offering them the transformative power of early dispute resolution. Start today and watch your practice, and your impact, flourish.

If you want to know more about EDR, consider joining the ABA Section of Dispute Resolution 's Early Dispute Resolution Committee and/or reach out to Felicia Harris Hoss, FCIArb , Ellie K. Vilendrer or Mary Cullen who are the forefront of this movement!
