Why do couples terminate their marriage?

1. Introduction.

Marriage is? different from weddings. Marriage is the union of a couple while a wedding is a one day event. Marriage is a continuous journey. It is a journey of? couples living peacefully, whether financially independent or not, and very comfortable enjoying their life together. The marriage is celebrated in a religious way also before the authority, yet the bridegroom gives the dowry to her bride.?

??????2° Legal Marriage according to the Family law

The marriage is considered legally celebrated when it is done before the civil registrar. The couple should fulfill all the legal conditions (Marriageable age, prohibition of the other marriage, issuing the celibacy certificate, etc…) If marriage is categorized among other? types of contract is obviously right. Therefore the contract can be terminated with some reasons.

Every time when couples get married they don't wish for anything that may disturb their peaceful time or their comfortable life. However, couples don't predict a downfall that might raise in their future relationship. There might be a misunderstanding in their journey or incompatibility during the time they have committed living together , financial incapacity, harassment of one the spouses, the kids born outside of marriage, adultery, household abandonment with many other circumstances that lead to the end of their journey.?

Grounds are many, legal ones are the main focus but we have social grounds also:?

1. Lack of Commitment.
2. Incompatibility between partners and disagreement.
3. Communication Problems.
4. Extramarital Affairs.
5. Financial Incompatibility.
6. Cheating your Partner
7. Addiction (Ex:Alcoholism)

The social grounds finally become legal grounds: conflicts someone can present to the court. We will highlight grounds terminating a marriage in a process of court resolution. Couples opt for divorce to avoid outrageous action like death, imprisonment etc.. Everything has a starting and ending point divorce also ends the union of couples. A spouse leaves his/her partner to get married or divorce to live peacefully for the rest of his/her life, because of the first deception.

Conflict in the family end up in litigation. One of the spouse has the right to file his/her case to the court. he/she can file a case based on one of the below grounds to be guaranteed divorce.

Divorce is the legal way to terminate marriage not only in Rwanda but across the globe. The Rwandan law N ° 36/2016 of 28/08/2016 governing persons and family has a specific article saying so.

???????4. Grounds provided by the law N ° 36/2016 of 28/08/2016 governing persons and family Article 218:

Any of the spouses may apply for divorce on one of the following grounds:

1° adultery.

It is even a crime according to Rwandan laws, however if one of the spouse has sexual intercourse outside the household commits the adultery.

2° desertion for a period of at least twelve (12) consecutive months;

3° conviction for an offense severely tainting the honour;

4° refusal to provide for the household needs;?

if one of the spouses doesn't? procure welfare to the family.

5° excess, abuse or serious insults by one?towards another;?

Saying Bad words or threatening jokes as harassment to your partner.

6° Gender-based violence;

The G.B.V has many forms which also happen in households.

7° de facto separation for a period of at least two (2) years;

8° non-cohabitation for more than twelve?

consecutive (12) months from the day of?

celebration of marriage on unjustifiable grounds.

??????5.Factors that ignite divorce if observed at the right time can't be the cause of separation.

Insufficient knowledge of each other in a couple.

When you marry a person, you marry his/her attitude, character, his/ her flaws, economic situation, and passion. it is not advisable to rush into a relationship and engage before you know him/her. During dating, couples do not show the real faces, but try to reveal. You need to know her/him likes, dislikes. How she/he manages different situations, how she handles problems. All of these help in the mutual development of your household. Knowing each other will not raise conflict after years of time to break your marriage.?

Illusion toward marriage after you commit to live together.

The love is wicked nowadays people pretends? to love their spouse. while she/he is targeting the fortune of the household.? After a certain period owing three to five complex house you break up with the purpose of sharing the property. It happens a lot when one of the couple was rich the other doesn't have any property. Therefore the court rule to divide your property once your matrimonial regime was community property.

Lust of sex creates adultery?

Among other serious factors to mentions are sex out of the union. In the social grounds we mentioned cheating your partner also the law consider the sexual intercourse done by one spouse to person as a crime. Cheating is a lack of Loyalty and lust for human beings. This behavior leads to adultery which is a legal ground to consider.?

lack of communication has been mentioned in social grounds that lead to break up of couples. Couples tend to be busy even when they have serious family issues, or remain silent instead of discussing issues which requires communication. They sometimes prefer to discuss with friends or neighbors instead of discussing with their partners.
