You've got a 250lb FB that runs 4.8 and a 235lb Linebacker that runs 4.6 seperated by 8 yds. The QB says "Hike" and a massive collision is about to happen in the B Gap! Weak side Iso, 27 Buck or 23iso. Call it what you want... it's all the same. Now who's at fault?
In the game of football no one is at fault unless you are getting yelled at by your coach that you were late to the contact point. Now... who's at fault in NYS for an auto accident? No one correct? Because we are a no fault state yes? NO! No Fault does not mean no one is at fault!
On occasion I hear people talking about NYS No Fault and how it applies to the damage of the vehicle. During the claims process, the assignment of physical damage fault is assigned. 50/50, 80/20... Fault is always assigned.
There is a big difference between "Physical Damage" and "Personal Injury Protection" within your auto policy. Physical damage is any damage to your vehicle at fault or not.. Your Personal Injury Protection will cover you and the individuals in your car for their medical expenses, lost earnings and incidental cost related to the accident up to the coverage limits.
