'Not charity, alimony is a fundamental right'

In a landmark ruling, the Supreme Court of India affirmed that Muslim women can seek maintenance from their husbands under Section 125 of the Criminal Procedure Code (CrPC).

Why this is historic? Before this ruling, there was ambiguity about whether Muslim women could seek maintenance as the Muslim Women (Protection of Rights on Divorce) Act, 1986, was enacted to nullify the Supreme Court's earlier judgment in the Shah Bano case.

  • The ruling reinforces the secular nature of Section 125 CrPC, ensuring maintenance rights for Muslim women comparable to those available to women of other communities.

Of note: The Supreme Court observed that maintenance is not charity but a fundamental right of married women.

  • It highlighted the importance of financial independence for homemakers, emphasizing their rights to joint accounts and ATM access.

The details:? Justices BV Nagarathna and Augustine George Masih emphasized that the Muslim Women (Protection of Rights on Divorce) Act, 1986, does not override Section 125 CrPC.

  • The Court dismissed a Muslim man's petition challenging an interim maintenance order for his divorced wife, ruling that Section 125 CrPC applies to all women, not just married ones.
  • The bench clarified that a divorced Muslim woman can also seek recourse under the Muslim Women (Protection of Rights on Marriage) Act, 2019.
