Who is at Fault in a T-Bone Collision?

Who is at Fault in a T-Bone Collision?

The determination of fault for a side impact or T-Bone collision will depend on where the accident occurred. An accident where one car is traveling straight and another car hits it in the side can happen frequently on the roads and city streets. Here are some examples of side impact collision scenarios:

  • A car side impact hits a vehicle in an intersection
  • A car turning left is hit by another vehicle while going straight through a light
  • A car turns left and misjudges the distance of an oncoming vehicle
  • A car makes an illegal U-turn in the road and side impacts another vehicle
  • A car backs out of a driveway and is side hit by a car unaware of the first car
  • A car skids off the road and side impacts another vehicle

Depending on the reasons for cars being involved in a side impact accident, it could be difficult to determine who is at fault for the collision. Factors that can distract any driver include:

  • Texting on a smartphone
  • Adjusting dials on the dashboard
  • Speeding
  • Driving under the influence of drugs or alcohol
  • Driver fatigue, on medication or driving while drowsy with sleep
  • Power outages at intersections
  • New or student drivers unable to avoid a collision
  • Failed brakes
  • Slippery or hazardous road conditions

In general, it is the case that side impact accidents are usually the fault of the party who hits the car on the side. But, in some situations, there can be fault attributed to both parties. For example, if a car backs out of a parking spot and is side impacted by another car in an automobile accident, then who is at fault? In those instances, the driver backing out needs to be sure it is safe to enter the traffic of the row of cars, or know how to look over taller cars in the way parked in the vicinity. Also, the car traveling straight needs to obey all speed limits as posted, and slow down for seeing any cars backing out into the main driving areas from parking spots.
