Where Do I Park ?
I was contacted by a title rep at a major title company. The problem was the engineer and the attorney for the developer did not touch base before the Condominium Plan and the Declaration of Restrictions were both recorded. The title officer did not adequately review both documents prior to recordation so as to avert the current situation, which, to be polite, is a mess.
What is the problem ? The Owners of a Condominium are not parking in the correct (assigned) Garage or Parking Space. Why ? The Garages and the Parking Spaces were not properly assigned on the recorded Condominium Plan. The recorded Declaration of Restrictions did not clearly address this issue.
Result ? "Free-for all" among the Owners. Further Result: The Owner of a Condominium in the Project could not sell his Unit because he could not assure the Buyer as to the answer to the above question. Worse Result: Unhappy realtors.
