The Second Amendment Institute is involved in three federal gun rights cases that are vital to the security and future of our Second Amendment rights. But, do they stand a chance in court? I think so. Here are the cases: Yzaguirre v. DC, Hanson v. DC, and Angelo v. DC.

Filed on Tuesday, June 25, 2024, Yzaguirre v. DC argues that a so-called assault weapons ban violates the Second Amendment.

Per the filed complaint, “Despite the Constitution’s unambiguous text and binding Supreme Court precedent the District categorically bans possessing, selling, transferring, purchasing, and receiving, constitutionally protected arms commonly possessed and used for lawful purposes, under pain of criminal sanctions.

The National Shooting Sports Foundation estimates there are 25 Million+ AR-15s in legal circulation.

Yzaguirre v. DC awaits its day in court as we wait for the Judge to set a preliminary hearing date. Even with Heller 1, Heller 2, and Bruen in the books, I think our chances of winning sit at 40% due to the Judge's past rulings and being an Obama appointee. Not worry though, if we lose at the circuit level in the District, we can appeal to the United States Court of Appeals.

Hanson v. DC, which challenges D.C.'s ban on "large capacity magazines" (LCMs), victory chances are pretty high; I'd set the bar at 90% for a 2-1 ruling at the United States Court of Appeals Third Circuit. This three Judge panel includes a Trump appointee, a Regan appointee, and an Obama appointee. During the case, D.C.'s strongest arguments were:

  • LCMs are not in common use - which was quickly corrected by the three Judge panel due to 250M+ in legal circulation.
  • LCMs are primarily used in crime - again, quickly disproven thanks to our friends at the National Shooting Sports Foundation and the Detachable Magazine Report (1991-2021). Read the article here.
  • Law-abiding citizens don't need LCMs for hunting or self-defense - again, quickly disproven thanks to the National Shooting Sports Foundation and the fact that our founding documents include the "Bill of RIGHTS" not the "Bill of NEEDS."

Angelo v. DC plaintiffs were denied due to the Obama-appointed Judge's ruling that the plaintiffs did not have standing to sue, despite suffering irreparable harm from D.C. by denying us the right to conceal carry on the metro with our valid, concealed carry licenses. We're currently waiting to hear back from the judge with our amended complaint.

Gun violence among top issues in DNC Platform

The DNC Platform touts the Biden administration's effort to tackle gun violence.

Delegates at the Democratic National Convention approved their platform Monday night and made efforts to curb gun violence a top priority.

The 92-page 2024 DNC Platform touted the work President Joe Biden and the Democratic nominee to replace him, Vice President Kamala Harris, have made on combating the scourge of gun violence in America.

A little over five pages of the platform have been dedicated to what the Democrats pledge to do about gun safety, improving policing and public safety, rehabilitating people released from prisons and protecting women against violence.

N.J. Governor Phil Murphy Ignores Bias Against Blacks and Systemic Racism Under His Leadership

New Jersey is no friend of the Second Amendment. Democratic Governor Phil Murphy has shown nothing but contempt for gun owners and the Second Amendment since taking office. One of the things that was uncovered and reported on quite a bit is that under Murphy’s administration, Blacks are denied permits to carry at a rate more than double their white counterparts. Those denials are predicated on an illegal subjective standard, not because of some sort of criminal history. Murphy’s office has been contacted repeatedly about this and has failed to comment.
