All About Trade Remedies!

What are Trade Remedies?

Trade remedies are actions taken in response to:

  • Subsidies (countervailing duties)
  • Sales at less than their fair value (antidumping) and
  • Import surges (safeguards)

Trade Remedy laws are Congressional Acts that delegate tariff and trade powers to the President and Executive branch, usually under the form of additional duties and/or quotas.

Why do Trade Remedies exist?

Trade remedies exist:

  • To combat various burdensome practices of domestic industries in violation of U.S. Trade Agreements
  • For the protection of U.S. national security
  • To deal with surges in imports

How are Trade Remedies enacted?

Trade remedies may take the form of:

  • Additional duties
  • Quotas
  • Temporary restrictions on importation


Common Trade Remedies and Special Entry Requirements

The following are a list of common trade remedies:

  • Section 201, CSPV cells and modules including Solar Panels comprising of CSPV cells
  • Section 232, Aluminum and Steel
  • Section 301, China origin goods

Entry filing requirements on imports of goods subject to Section 201, 232, and 301 import duties;

Entry filing requirements on imports of goods subject to Section 232 duty exclusions approved by the U.S. Department of Commerce, and Section 301 exclusions approved b the Office of the U.S. Trade Representative; and
