What are the rules for the Posh Act?

An important piece of legislation in India that attempts to provide safe working conditions for all workers is the Posh Act (Prevention of Sexual Harassment at Workplace).

It requires all organizations with more than ten workers to set up an Internal Complaints Committee (ICC) in order to manage sexual harassment claims. Companies must regularly hold awareness campaigns to inform staff members of their rights and the steps involved in reporting harassment.

  • The Act places a strong emphasis on maintaining the privacy of both the complainant and the accused during an investigation.
  • As per the provisions of the POSH Act, every workplace employing 10 (Ten) or more employees is required to constitute an Internal Committee ("Internal Committee") to handle complaints related to Sexual Harassment and facilitate inquiry into the complaint.
  • There are consequences for breaking the Posh Act, including fines and legal prosecution.
  • The Act aims to promote an inclusive, courteous, and harassment-free working atmosphere by implementing these requirements.

To conclude, the Posh Act is essential to advancing gender equality and guaranteeing that everyone may work in a setting that upholds their safety and dignity.
