The reason why I received this email is because I am part of the NSD - Special Taxing District in Royal Oaks East and Section 1. Now, for transparency I am not here representing the Board, nobody should think that I am here representing the Board, I am just a member that received an email. Now, this email and I am only going to read part of it: "Following a recent legal review procedure by our Town Deputy Attorney, we will soon be implementing a new procedure at our Guard Gates. Security Personnel will begin requesting identification and destination of all visitors. This is a change from our previous practice when no information was required from drivers. YES, this is definitely a change of the ordinance that created these Special Taxing Districts years ago by Miami-Dade County. But, as many of you are aware, all these guard houses are on public roads and you can't ask individuals to identify themselves or worse yet... where they are coming from or information as to where they are going. That is unconstitutional. Now, better yet, or better stated, they are NOT required to provide this information. You can ask... which will only cause one terrific traffic jam, certainly on the street that affects me. [Mentions the particular streets that will be affected.] You are going to create needless traffic jams there, asking for information that is not required and really doesn't provide any additional security. Then, of course, we can get into Federal Law, State Law that prohibits all except certain entities - LAW ENFORCEMENT - that can have access to drivers license information. I have a major concern with this information whether it will be properly stored and who is going to have access to it. I am obviously out of time, but I would like you all to take this up and... like I said, give us an answer as to where this comes from. Thank you."

@ 32:48 Walter Gil Item 14 E: Commercial Vehicles in Residential Areas (Fernandez) For over 20 years their A/C truck has been parked in front of their property and now, all of a sudden, there is a lien on his property for his father's A/C truck being parked on their driveway. It is behind a fenced gate where no one can see it and it does not bother anyone. Yet, for over two years a commercial vehicle has parked on the street down the road and that has been allowed because there is no property to put a lien on. For us it is our livelihood.

You do not want an old person suffer a heat stroke because you force them to park away from their home. My father had hip replacement and spinal surgery and I am taking time off to help him. Speed bumps, there was a car that flew so fast that by the car being outside saved a girl speed bumps are needed

Let's ask, if on the first day, a committee member is shown a way in without following the Committee Rules, what can be expected the lessons learned are? Committee Rules Section 11

40:26 Councilman Joshua Dieguez asks what are the rules that are being waived and questions the nomination of one person because she has neither attended an Elderly Affairs Committee meeting nor has she met with the Chair of the Committee... interestingly enough... all vote to proceed with the nomination even though they are disregarding the very rule requested by the Chairs of the committees... but Joshua Dieguez votes NO... BRAVO JOSHUA!

Each person appointed to a Committee shall be appointed by the Town Council in the following manner:

(a) Any qualified person, wishing to serve on a Committee shall, prior to submittal of an application, attend one regularly scheduled committee meeting and discuss his desire to join the Committee with the Committee Chair.

(b) Any qualified person who has completed the requirement of subsection (a), shall submit a complete application to the Town Clerk.

The word SHALL leaves no room for the Council to waive the rule but they do which means they ask us to follow the rules and never apply it to themselves! Finally... some are living up to their OATH OF OFFICE, thank you C. Joshua Dieguez

What is an Oath?

It is an honor to serve one’s community as a local government official.? Regardless of the capacity in which one serves, the administration of the official’s duties will have a significant effect on the official’s locality.?As we watch Council Meetings we are left bewildered as to the reasoning behind the votes of the Council.

Councilman Joshua Dieguez is an Attorney and when he asked if the nominee to the Elderly Affairs Committee had:

A. Attended a meeting as required? The Answer was NO!

B. Met with the Chair of the Elderly Affairs Committee? The Answer was NO!

C. Know about the Committee Rules? The Answer was NO!

Therefore, he said NO to the nomination, while all other Council Members voted in the affirmative... Why?

Because they have seen the nominee attend many events; because they 'love her' and know she will do a great job; because 'she loves the elderly' and has many ideas to bring to the Committee...

But Councilman Joshua Dieguez's points were based in adhering to his Oath of Office... If the Town Council approved and holds everyone accountable to the Rules and Regulations of Committees whereas Section 11 specifically says:

Section 11. Appointments, Vacancies and Resignations.

Each person appointed to a Committee shall be appointed by the Town Council in the following manner:

(a) Any qualified person, wishing to serve on a Committee SHALL, prior to submittal of an application, attend one regularly scheduled committee meeting and discuss his desire to join the Committee with the Committee Chair.

(b) Any qualified person who has completed the requirement of subsection (a), SHALL submit a complete application to the Town Clerk.

Failing to do any of the steps that SHALL be done prior to nomination is a violation of the rules... So... we ask rather serious question:

If your rules are not followed by you... why should we follow your rules?

An Oath of Office is NOT a mere formality, the oath is a public pledge that the official understands the requirements of the position, and will work to meet or exceed those requirements.? Those taking the oath must fully consider the meaning of the oath and all of its important implications.

An oath is a formal promise which, traditionally invokes God, or something else which the taker of the oath considers sacred, to act as a witness to the oath taker’s sincere intention to fulfill that promise.? In this way, the oath was historically thought not only to bind the oath taker to the laws of man, but to a higher moral authority as well.? Oath takers can “affirm,” rather than “swear,” and omit reference to God.

Oaths of office date back at least to the time of ancient Rome, and, since then oaths have become a staple of representative government.? Oaths have been a requirement for public office from the nation’s inception.? State and local governments adopted oaths modeled after the federal oath, and the taking of an oath has become a requisite for holding nearly any public office.

An OATH OF OFFICE is not a great photo opportunity!

Oath takers pledge to “faithfully and impartially discharge all duties” required of them by their office, imposing on all local officials an affirmative duty to avoid all conflicts and ensure impartiality in the execution of all of the official’s duties to include prohibits the taking of bribes, requires the disclosure of any personal interests the official may have in transactions involving the locality which he or she serves, and requires disqualification in cases where a personal interest makes impartiality impossible.?While the official is solely responsible for complying with Oath of Office and when they break/violate the Oath of Office there seems to be no consequence, we, the people are left bewildered as to how easy and soon after taking the Oath the elected officials seem to forget that above all they are setting an example through behavioral display of wonton disregard for the rules, regulations, resolutions and ordinances they force upon others.

The oath of a newly elected official requires officials to “discharge all duties incumbent upon” them, as holders of their particular office, “to the best of [their] ability.”? City and Town Councils, Boards of Zoning Appeals, and Planning & Zoning each have distinct requirements by which they must abide, in addition to the general requirements which govern them all.?Each governing body is charged with adopting its own rules, procedures and policy, and abiding by them.? Each official is personally responsible to both learn and follow all legal requirements to which the public body is subject.? Failure to do so, depending on the specific circumstances, may result in consequences ranging from the invalidation of the public body’s actions to prosecution of the body’s members.

May document be read before Council Meetings, may we continue to witness a desire to adhere to the rules The Town of Miami Lakes Council has enacted... otherwise... why bother to remain incorporated?

14. NEW BUSINESS

a. Honoring Senator Bob Graham (Dieguez)

Recommendation:

I know I speak for all members of the Town Council, the Town Administration, and Miami Lakes residents when I say we were all saddened by the loss of our late Florida Governor and Senator, Daniel Robert Graham a/k/a Bob Graham. Senator Graham has been an inspiration to so many elected officials and community volunteers on both sides of the aisle. His example of treating everyone fairly and with respect even if they were working against you is an example that is more relevant today than at any other point in our lifetimes. Additionally, even though his brother was the visionary behind the Town of Miami Lakes, it was Senator Graham who really put our hometown on the map. It feels only fitting that the Town Council should take steps to honor his memory and example.

After speaking with a few residents, we decided that naming a building was not enough particularly since Bob Graham Education Center already shares his name. Instead, the consensus was that because he put our town on the map, we need to ensure that future generations of Miami Lakers and residents remember his name in perpetuity and welcome residents, visitors, and commuters alike to the place we love and call home. Accordingly, I move to rename Miami Lakes Drive after Senator Graham and direct the Town Administration to take all appropriate steps to carry out this directive forthwith and coordinate with members of his family and other dignitaries to prepare a fitting ceremony in his hono

b. Speed Humps/Traffic Calming Along Palmetto Palm Avenue (Collazo)

Recommendation:

I have received calls from residents living along Palmetto Palm Avenue requesting that the Town evaluate traffic calming strategies to slow down speeders.

I would like to have a conversation with my colleagues, directing staff to take a look at this issue, and if warranted, the addition of speed humps and / or other traffic calming strategies.

c. Town of Miami Lakes Police Department (Cid)

Utilizing the carry-forward funds, I would like to direct staff to immediately hire 3 additional officers to our force (1 Day shift, 1 Afternoon shift, 1 Midnight shift). Additionally, I would like to direct staff to begin the implementation of the 4/10 schedule for our police department.

I encourage my colleagues to review the police survey in preparation for the discussion on the initiatives outlined in this item.

d. Palmetto Palm Avenue and Mahogany Court Speed Humps and Signage (Morera)

Recommendation:

I received numerous complaints of speeding on Palmetto Palm Avenue and Mahogany Court. In fact, some time ago, residents of Palmetto Palm Avenue joined together to sign a petition requesting that the Town install speed bumps. At the time, installation of speed bumps required county approval, and the County denied the request. However, as of March 29, 2024, the Town and the County entered into an Intergovernmental Agency Agreement to Perform Traffic Engineering Functions (“IAA”) which allows the Town to install speed humps without needing to go through the County under certain conditions.

Palmetto Palm Avenue and Mahogany Court are purely residential roads which are

  1. relatively long and straight, and
  2. often used as shortcuts between Miami Lakes Drive and Miami Lakeway South. Both of these factors contribute to speeding on what should be calm residential streets. Moreover, Palmetto Palm Avenue and Mahogany Court each respectively serve large pocket-parks situated directly adjacent to the road where children often play, for a total of four pocket parks. While walking the community, I personally observed numerous cars travelling at very high rates of speed, both during the day, and during the night when visibility is greatly reduced. This combination of factors creates a recipe for tragedy.

I would like to have a discussion with my colleagues about installing speed bumps on Palmetto Palm Avenue and Mahogany Court in accordance with the criteria and procedures outlined in the IAA. I would also like to discuss whether the traffic engineering studies previously performed by the Town/County on Palmetto Palm Avenue satisfy the requirements of Section 3 of the IAA, such that we can submit those studies to DTPW and avoid unnecessary expenditure of funds on such a study when the County already performed them not long ago.

05-10-2024 After reading the Agenda, I filed a Public Records Request to read the March 29, 2024 Intergovernmental Agency Agreement to Perform Traffic Engineering Functions (“IAA”) which allows the Town to install speed humps without needing to go through the County under certain conditions. The Town Clerk acknowledged the request which was marked Time Sensitive to give us an opportunity to read, understand to provide informed public comments

It was NOT received on time, therefore I filed a Second and Third requests on Public Records that are pending... Let's review the Agreement which was finally received on 05-15-2024

The criteria for implementing speed bumps or speed humps, as per the traffic calming criteria, involve a combination of factors that need to be met. Here's a summary of the key criteria:

1. Minimum Traffic Volume: The street must meet certain daily traffic volume thresholds to be considered for traffic calming measures:

e. Commercial Vehicles in Residential Areas (Fernandez)

Recommendation:

I would like to

propose modifying Section 13-1607 of the town code to allow for the parking of certain types of commercial vehicles, where feasible that it be parked behind the fence-line of a property within a residential district, and obscured from the public view. This would not supersede or limit the ability to enforce prior deed restrictions or restrictions placed by homeowner\condo associations.

f. School Zone Signage (Garcia)

Recommendation:

I would like to ask staff to research our catholic and private schools to see if they have the same school zone sinage as our public and charter schools to insure student safety.

g. Business Toolkit (Dieguez)

Recommendation:

I move to direct the Town Manager to work with staff to prepare a “Business Toolkit” designed to provide businesses in Miami Lakes with basic resources and information.

h. Pavilion at Miami Lakes Veterans Park to be Named after Gary Cardenas (Collazo)

Recommendation:

I would like to have a conversation with my colleagues regarding the naming of one of the pavilions at Miami Lakes Veterans Park after Gary Cardenas.

i. Gigi's Playhouse MOU (Cid)

Recommendation:

I would like to direct our attorneys to begin the formulation of an MOU with Gigi’s Playhouse in Miami Lakes. This will be a big step toward inclusion at Town Hall as we would welcome the first member of our team with Down Syndrome.

Additionally, I would like to direct our Federal Lobbyist to include in the towns priorities the Charlotte Woodward Organ Transplant Discrimination Prevention Act.

j. Mental Health Awareness Month (Morera)

Recommendation:

Since 1949, the United States has recognized the month of May as Mental Health Awareness Month.

Currently, 46% percent of Americans will meet the criteria for a diagnosable mental health condition sometime in their life, and half of those people will develop conditions by the age of 14.

Mental health conditions take many forms, and include anxiety, addiction/substance abuse, bipolar disorder, depression, PTSD, schizophrenia, suicidal thoughts, and more.

In observance of Mental Health Awareness Month, I would like to discuss with my colleagues how our Town can promote Mental Health Awareness, including potentially adding a drop-down banner on the Town's website providing a link to critical free-of-charge resources available at the following link: https://mhanational.org/get-help.

k. Filling of Council-member Vacancies (Fernandez)

Recommendation:

In order to serve the public interest, by eliminating the need for undue spending, and to maximize the ability of all Miami Lakers to participate in the electoral process, I would like to request the following ballot question be asked of the voters, at the next scheduled town-wide election.

Should Section 2.5 of the Town Charter be amended to provide that a vacancy caused by the Mayor or Councilmembers desire to seek higher or alternative office, and said resignation be required under law, upon tendering a letter of resignation to the Town Clerk, an election shall be held to fill the vacancy at the next regularly scheduled municipal election.

l. Adopt a Road/Park Program (Garcia)

Recommendation:

I would like to establish an adopt a road/park program utilizing our local boy and girl scouts and schools while working the NIC and staff.

m. Enhanced Code Enforcement (Dieguez)

Recommendation:

I move to direct the Town Administration to begin reviewing social media postings for postings related to efficiency rentals in Miami Lakes and to incorporate new technologies to ensure compliance with the Town Code.

?n. Mental Health Awareness Month (Collazo)

Recommendation:

May is mental health awareness month. I would like to have a discussion with my colleagues regarding lighting Town Hall in green for the month of May.

Recommendation:

I would like to request an up or down vote of the council on the pending ML Optimist Club contract for the baseball, softball and flag football program in our Town.

Recommendation:

I would like to request that the initial budget proposal presented by staff during the budget process be based on the roll back rate for ad-valorem taxes. I would also like to consider allocating a substantial portion of the previous year carry-forward amount to further lower the millage rate, and provide further relief to our residents.

On Monday, October 23, 2023 at 1:55 am, a burglary to a vehicle occurred at 14001 Lake Success Place. The incident was captured by the victim's cameras, and it showed an unknown white male rummaging through the victim's vehicle. The victim's vehicles were processed, and a Need to ID flyer was disseminated.

During the course of Detective Nieves investigation she received a Latent Unit Report dated April 8, 2024, indicating a print hit which came back to the arrestee, Reinier Hernandez, Jr. It was determined that Hernandez is currently in custody at Metro West, and the arrest affidavit was submitted with the added charges.

?c. Landscaping to Remove Excess Leaves Report (Bajdaun)

Council Item (Garcia- April 9, 2024; 14h) Update

Town staff evaluated the cost of adding a Town-wide landscape crew solely focused on leaf pickup throughout all Town-maintained corridors and greenspaces. With excessive leaf fall taking place for most of the first four (4) months of the year, additional attention to leaf pickup from the landscape crews providing regular service can create a slowdown and delay in completing mowing cycles. Additionally, our traditional maintenance cycle does not provide for weekly services, meaning some areas will only be addressed two times a month, which allows for excessive leaf build-up.

To better address this seasonal concern and remain proactive, staff recommends funding a pilot (temporary) period for testing a new weekly leaf pickup crew in the upcoming fiscal year not exceeding $13,360.00 (thirteen thousand three hundred and sixty dollars) for a total of eight (8) days of service. The service will be requested as needed once we approach the season and experience excessive leaf fall. Staff would then evaluate the best times to implement the weekly crew on two (2) occasions and measure the efficiency of the new level of service. This approach will allow us to see the impact of a dedicated crew and if it yields a positive outcome to support future funding considerations.
