What implications does it have for the transmission of data if Great Britain leaves the European Union ( #Brexit ) on 31.01.2020?
For the moment everything will remain the same. Until 31.12.2020, Great Britain will be treated as if it still belonged to the EU. This so-called transitional phase aims to regulate the future relationship between the partners. Although the EU has granted Great Britain the theoretical possibility of extending the transition phase by one or two years until the end of 2022 at the latest, the EU has not yet made any decisions on the future of the country. However, this possibility was excluded by the law decided in the British House of Commons.
Whether and how the final arrangements will be made is likely to be the subject of further intensive negotiations in the coming months.
At the end of the transitional period, Great Britain will then be a third country from the point of view of data protection law, to which the special regulations of Articles 44 to 49 of the GDPR will apply. In order to continue to guarantee trouble-free data exchange between the partners, it would be desirable for Great Britain to be classified as a "third country with an adequate level of protection" in the same way as Switzerland, for example. By the end of the transitional period, the EU-Commission should decide on an adequacy decision in accordance with Art. 45 GDPR.
However, a corresponding assessment by the EU-Commission can of course only be made once it is known what data protection laws the UK will give itself, which means that the first step must once again be taken by the British...
