Implied Consent (DMV) License Suspension

For many folks, the first concern after a DUI arrest is whether or not they can drive legally. If your valid Oregon license was taken at the time of arrest, then you are usually eligible for a temporary permit which allows you to drive for 30 days before an “Implied Consent” license suspension?kicks in. Check the paperwork from your arrest for that permit, and make sure to carry that with you when driving. To learn about the Implied Consent process and what you can do to avoid suspension, read this post. Please note that this DMV-imposed suspension is totally separate from any license sanction imposed by the court if you are convicted of the criminal charge of DUI.

Criminal Case

The first court date after your arrest is called an arraignment. This is the court date listed on your citation(s) or your release agreement. You are not expected to resolve your case at this first appearance. Rather this is a time to route your case to a date where it could be resolved. Typically, arraignment is a few weeks after arrest, but in some places (like Multnomah County), the arraignment happens as soon as the next day. Missing this court date may lead to a warrant being issued for your arrest, so please make sure to be there on time. For more information on arraignments, read our blog post on the subject. Between arraignment and your next court date (called different names in different courts) you should have ample time to review the evidence and settlement options with your legal team, and then make informed decisions from there.

Jail, Fines, and Other Consequences

Beyond those first steps, there are many variables that come into play, so it is hard to generalize without talking through the specifics of your case.
