What Does it Mean to Say a Divorce is Uncontested?

Too often people think that the phrase “uncontested divorce” means that you agree to get a divorce. Television and movies help shape that notion with the epic scenes where one of the parties finally signs the papers and “gives” the other one the divorce they are otherwise apparently holding over their head.

What is more likely is that the paperwork is part of a settlement agreement, maybe a product of mediation and negotiation. When a couple just wants a divorce but does not want to litigate and do battle, they can agree to split things the way they see fit. That said, there are many rights, duties, and issues that must be addressed and acknowledged in writing.
