Navigating the USCIS immigration process can be very challenging. ?Some case processing take several months while others may take years. There may be times during the process when an applicant or petitioner feels there is nothing they can do to help a case along that is taking longer than the suggested processing times or when an urgent needs arises for faster adjudication. There are options available that may help move a case along,?
If your immigration case is taking longer than normal, there are actions you can take:
- Call a USCIS Customer Service Representative. You can call a customer service representative at USCIS. (1-800-375-5283) This process can be a very frustrating experience and can take awhile to get through to someone. The typical USCIS customer service representative is not able to answer detailed questions, and the information they provide is often the same as you already have received by mail or through the online case status. Calling USCIS is a step that should be taken as it can lead to notifying the officer handling your case of the inquiry in some instances.
- USCIS offers an online chat function through “Emma.” Emma answers general questions about your immigration case.
- Submit an Online Case Inquiry.
- Make an Infopass Appointment with USCIS.
- Write a letter to USCIS asking for clarification on your case.
- Congressional Assistance - inquire with your congressional representative if you are petitioning for a loved one or are a US company.
- Request assistance from the USCIS Ombudsman’s Office.? This department provides individual case assistance after other available options have been exhausted. It acts as a liaison between USCIS and the applicant/petitioner
- Contact an immigration lawyer and threaten a lawsuit. A mandamus action can order a government official to fulfill their duties or take action in a case where there is a finding of abuse of discretion by an administrative agency
