What Actions Must you Take if you are Arrested?

If you or a loved one is ever arrested, please do the following three things:

1) Comply with all Officer Requests. Officers have discretion when assessing an arrested person's conduct. In an effort to avoid further charges or use of force from the Officer always remember to comply with the Officer commands and/or requests.

2) Exercise your 5th Amendment Right to Remain Silent. While you should be complying with Officer's request for information, please do not make any statements regarding your case. When you make a statement, this statement can and usually will be used against you in a criminal case. Even if you feel as though the basis of the arrest is false, please do not make any statements. Also, request counsel. You have a right to speak with an attorney if you are ever questioned by the police.

3) Decline all Searches. If Law Enforcement Knocks at your Door, request a Warrant. If there is no Warrant, you can decline the Officer's search. Also, if an Officer requests to search your vehicle, you can decline consent to search. Remember, if an Officer asks to search anything, decline all searches absent a Warrant. If the Police have a Warrant, ask to see the Warrant to verify the information.
