Welcome to the TLO Monthly Digest

We welcome you to the first TLO Monthly Digest newsletter, in which we plan to discuss aspects of personal injury law that may give you a clearer understanding of what lawyers in our line of work do. We hope to shed light on some of the ways we help clients as well as share information that will be useful to everyone—including safety information, tips for those pursuing legal action, and more.

In keeping with that theme, this month, we'd like to share more about the full breadth of cases attorneys like ours at Thomas Law Offices handle. We've found that there’s a common misconception that personal injury lawyers only handle motor vehicle accidents, nursing home abuse cases, medical malpractice cases, and perhaps a few mass torts (class action) lawsuits. While we certainly regularly handle those types of cases, we also handle a fair share of others you might not have typically associated with this practice area.

These types of cases include:

Negligent Security

The repercussions can be significant if a property owner is aware of upticks in crime rates and fails to take measures to secure their premises to keep residents, workers, or visitors safe. Adverse outcomes can occur if there is poor lighting, non-operational surveillance footage, or a security guard is delinquent in carrying out their responsibilities, whether it’s because they’re undertrained or they don’t adequately perform their job tasks.

Many violent crimes, like robberies and carjackings, rapes and other non-sexual physical assaults, and gun violence in workplaces and schools occur because property or business owners didn't have viable safety measures in place. Or, if they did, it failed them, as may be the case with a negligent security guard. This oversight often leads to individuals unnecessarily getting hurt or losing their lives, and personal injury lawyers like ours often represent those victims' interests in situations like those.

Sexual Assault

When many people think about sexually-charged acts, such as sexual assault, they often concern themselves with ensuring a person faces criminal charges, when appropriate, for their actions. Sexual assault victims and victims' advocates aside, we've found that few individuals emphasize accountability on a deeper level after instances of assault.

Our attorneys have made a name for ourselves by advocating for those who would otherwise suffer in silence. Our advocacy on behalf of sexual assault victims centers around holding the perpetrators of such acts and anyone else who was permissive of the impropriety liable for their actions and inactions that allowed such an environment to exist. In filing a civil claim in addition to criminal charges, this also may bring to light new evidence in the case or help change mandates that can protect others.

Medical Providers' Failures To Render Aid

Personal injury lawyers also often handle medical malpractice cases against health care providers other than physicians. There have been several recent cases in the news in which nurses have given patients the wrong medication or too much or too little of it, causing their health to take a downturn or die. Then there have been recent cases in the news where paramedics have refused to treat patients when arriving at a scene where the victims were clearly in distress and needed medical aid.

These are just two examples of health care professionals who had a responsibility to exercise a certain standard of care in taking care of patients but allegedly failed to do so. Injured or ill victims or their surviving family members have a right to hold liable parties accountable for their negligence. By doing so, victims may recover a monetary award to cover their newfound medical bills, pain and suffering or mental anguish, and damages for other costs incurred from the incident.

How This Information Can Help

Our hope is that our dispelling of some myths regarding perceptions of the types of cases personal injury lawyers handle will encourage more victims to step forward and take action to hold negligent parties accountable for their actions. We genuinely believe this is the first step in the right direction toward reducing the incidence rate of preventable injuries, illnesses, and fatalities.

If you or anyone you know has suffered harm due to the negligence of another, contact Thomas Law Offices to preserve the right to take legal action before the statute of limitations runs out. Get in touch with us to learn how we can help.
