We helped an F1 status researcher with 25 citations win an approval of I-140 EB2NIW Green Card application.

Recently, our law firm helped an F1 status researcher in the field of biological control receive an approval of her I-140 NIW petition from the USCIS Nebraska Service Center (NSC). The client received her Ph.D. degree in a subfield of zoology and has been working as a researcher at a university in the U.S. Her current research focuses on pest management for the benefit of agricultural production using eco-friendly methods.

The client made a wise decision to file a self-petitioned EB2NIW instead of pursuing an employer sponsored application because she had a plan to change her job in the future. EB2NIW gives her freedom to change jobs and employers during the green card application process so long as her new job is in her area of specialty and serves the national interest of the United States.

For filing her EB2NIW petition, Client had prepared the following documentary evidence based on our 'Document Preparation Instructions': 1) about six papers published in professional peer-reviewed journals, as well as two manuscripts/accepted papers, etc.; 2) about ten conference presentations; 3) about 25 citations of her published papers; 4) 5 recommendation letters; and 5) evidence to explain the national importance of her ongoing work. Client's I-140 EB2NIW petition was recently approved smoothly without CIS Request for Evidence (RFE). 

There is uncertainty regarding future waiting time for a green card at this stage as it is reported that the House and Senate are negotiating a proposed change to the allocation of employment-based visas for high-skilled immigrants that could win approval. If passed into law in the future, it could lead to changes in visa backlog situations.
