Waivers of Subrogation

In Illinois there was a decision that is an important reminder of the value having a mutual waiver of subrogation in your design contract. A court granted summary judgment for the architect based on the clause, who avoided costly litigation and potentially significant damages because of the waiver of subrogation clause in their contract. The Bd. of Trs. of Oakton v.
