1. How many days off are there for September 2nd?
The September 2nd holiday, Independence Day, grants employees 2 days off. This includes September 2 itself and either the day immediately before or after. According to Point ?, Clause 1, Article 112 of the Labor Code No. 45/2019/QH14, this arrangement allows for a full celebration of Independence Day.
September 2nd marks a significant historical event in Vietnam: on this day in 1945, President H? Chí Minh declared the country’s independence from colonial rule at Ba ?ình Square in Hanoi. This declaration led to the founding of the Democratic Republic of Vietnam, which later became the Socialist Republic of Vietnam. Thus, Independence Day is a major national celebration, honoring the country's history and sovereignty.
2. Holiday schedule for September 2nd, 2024
The Prime Minister has approved the holiday schedule for Independence Day 2024 based on proposals from the Ministry of Labor, Invalids, and Social Affairs. The key points are:
Notification Requirement: Employers must inform employees of the Independence Day holiday schedule at least 30 days in advance to ensure proper planning and preparation.

3. How will the employee be paid for working on 2 September?
According to Article 112 of the Labor Code, employees are entitled to a day off with full pay on Independence Day. Since Independence Day is a paid holiday, working on this day is considered overtime work during holidays.
Under Article 98 of the Labor Code and Article 55 of Decree 145/2020/N?-CP, the wages for working on holidays and festivals are as follows:
1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:
a) On normal days: at least 150%;
b) On weekly days off: at least 200%;
c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend, or public holiday.
