Victory in Court!

Today, I got up at 6:00 a.m. to shower and put my suit on. I then headed out to Hastings (Dakota County) to start trial on our Adverse Possession case. I wrote about this the other day.

I met my wonderful colleague and Real Estate guru, Amy Mattson. We also had our surveyor, Jason Rud from E.G. Rud and Sons show up with a major league blow up of the survey with the disputed area which our client used for 38 years; and, over that time, installed a concrete and gravel driveway and put up a retaining wall for water diversion. The driveway and retaining wall encroached on the Defendants' property by about 2 feet. The Defendants wanted our client to tear up two feet of his driveway and get other improvements off his property. We were ready to go.

I was expecting to argue motions in limine (suppress certain evidence). Instead, Judge Bryce Ehrman (great judge) took the bench and gave some hard wisdom to the parties about trial and likely taking up to 90 days to issue his Order. We would know who are President is by then, and likely, rolling into 2025. He wanted us to discuss settlement, again.

With our team, we cut a fantastic deal with the Defendants. In essence, they are granting our clients a permanent (forever) easement that "runs with the land". This means, who ever ends up with the properties 30 years from now, the easement will be recorded and applied to the properties. This essentially means our client can continue to use the driveway and even two extra feet behind it (bingo bonus).
