Recent legal actions are anticipated to impact the National Association of Realtors (NAR) and affiliated brokerages regarding their commission policies. A jury has found NAR, alongside companies such as Keller Williams and HomeServices of America, guilty of colluding over commission rates, resulting in a substantial $1.78 billion in damages ordered to be paid by these entities. This landmark decision, rooted in allegations of collusion facilitated by NAR’s Clear Cooperation Policy, is likely to initiate changes within our industry. Yet, as history has demonstrated, our profession is resilient and adaptive, capable of thriving amidst transformation.
In my lifetime of dedicated service within the real estate profession, I've witnessed our community's unwavering commitment to ethics and integrity. Antitrust violations are not a part of our conduct—this is a testament to our high ethical standards. We stand united, and together, we will navigate this new terrain, as we have others in the past, with fortitude and unity.
The verdict, while challenging, does not diminish the indispensable role of buyers' agents. Their contributions are fundamental to the intricate process of real estate transactions and will continue to be recognized and compensated in the free market system where we operate. These professionals offer:
