Value of IP for Start-ups

I get questions from individuals with a business idea often on how important Intellectual Property (IP) is to their potential business. I respond that if you're already thinking about IP you're on the right track. That means you value your idea enough to protect it.

One thing about our great country is that we're not a first to invent country, we are a first to file, so that alone should indicate the importance of you filing.

If it's a patent idea filing should be considered very early, even if it's a provisional filing in order to prevent loss of rights.

With trademarks, simply search USTPO to see if your desired mark is available. One good thing about trademarks is they are protected by the statutes of common law, if its in use (by you in the market place) then it is protected.

However, if someone is to infringe on your mark and it's not filed you CANNOT cease and desist in order to stop use/infringement or bring forth a claim.
