Unprecedented Exodus of Judges Sparks Speculation and Crisis in Pakistan's Judiciary

In a shocking turn of events, the crisis in Pakistan's judiciary has further escalated with the unexpected resignation of Justice Shahid Jamil Khan from the Lahore High Court (LHC). Citing personal reasons, Justice Khan, who was in line to become the chief justice, has sent his resignation to President Arif Alvi, leaving a void that adds to the recent departures of two Supreme Court judges, Justice Ijaz Ul Ahsan and Justice Mazahar Ali Akbar Naqvi.

Justice Khan, who was set to retire in 2029, penned his resignation letter, expressing gratitude for the honor of serving as a judge for a decade. However, he cryptically alluded to personal circumstances that led him to "turn the page and start a new chapter." In a poignant twist, he included a proverb in his resignation letter: "An ounce of discretion is worth a pound of wit."

Last month, the legal fraternity was rattled when two Supreme Court judges stepped down from their positions. Justice Ahsan, the third senior-most judge, expressed his desire not to continue as a top court judge just two days before Justice Naqvi's resignation. The latter stepped down after the Supreme Judicial Council (SJC) declined to halt proceedings against him, stating that a stay cannot be granted without hearing the case on merits.

The SJC had issued a show cause notice to Justice Naqvi on October 27, 2023, amid allegations of bench manipulation and financial misconduct. The departures of these senior judges, considered "close" to former Chief Justice Umar Ata Bandial, have fueled speculation, with analysts suggesting their involvement in issuing controversial orders.

Former CJP Bandial's tenure was marked by visible fault lines among the top court's judges, a trend that diminished when CJP Isa assumed office. Nevertheless, the damage appears to have been done, as the resignations continue to send shockwaves through Pakistan's legal landscape.

The unprecedented exodus of judges has raised concerns about the stability and integrity of the country's judiciary. Critics argue that the departures may be indicative of internal conflicts and institutional challenges within the judiciary, while others speculate about potential political influence on the judicial system.

As the nation grapples with this crisis, the immediate and long-term implications on the rule of law and the functioning of the judiciary remain uncertain. The resignations of key judicial figures cast a shadow over the legal landscape, leaving many to wonder what lies ahead for Pakistan's justice system.

These judges degraded themselves by aligning with political parties and deserved to be kicked out. Lesson for future such politically inclined judges too
