Unplugged - The Right to Disconnect is Coming.

In the ever-evolving world we live in, the line between work and personal life has become increasingly blurred. The advent of digital communication tools, while enhancing productivity, has also made it challenging to truly "switch off." Recognizing this modern-day dilemma, Australia is joining a global movement towards the Right to Disconnect laws, aimed at creating a healthier work-life balance for employees.

This change starts on:

  • 26 August 2024 for Businesses employing over 15 staff, and
  • 26 August 2025 for Businesses employing less than 15 staff.

Understanding the Right to Disconnect

The Right to Disconnect legislation is designed to protect employees from the expectation of being available for work communications outside of their standard working hours. This means no more late-night emails, weekend calls, or urgent after-hours texts unless absolutely necessary. The goal is to reduce burnout and promote mental well-being by ensuring that personal time remains just that—personal.

Global Context of Right to Disconnect Laws

Australia is not alone in this endeavour. Several countries around the world have already implemented Right to Disconnect laws, providing valuable models for us to consider.

  1. European Union: The European Parliament has been a strong advocate for the Right to Disconnect. In January 2021, they voted in favour of a resolution calling for an EU-wide law that grants workers the right to digitally disconnect from work without facing negative consequences.
  2. France: One of the pioneers in this area. Since January 2017, French labour laws require companies with more than 50 employees to negotiate the terms of digital disconnection. This initiative aims to reduce work-related stress and improve the work-life balance.
  3. Belgium: Belgium introduced its Right to Disconnect law in February 2022, which applies to employees in both the private and public sectors. Employers are required to implement measures that ensure workers can disconnect from work outside regular hours.
  4. Ireland: In April 2021, Ireland's Workplace Relations Commission issued a code of practice on the Right to Disconnect. This code provides guidance to employers and employees on best practices for switching off after work hours.
  5. Canada: Ontario passed legislation in 2021 that requires employers with 25 or more employees to develop a written policy on employees' right to disconnect from work. This law came into effect in January 2022.

Tips to help implement the Right to Disconnect in Your Practice

I've always believed that for most people tasks expand into the time available to complete them, so now that time is no longer (in a work context) almost infinite, how do we manage time?

  1. Set Clear Expectations: Clearly define work hours and communication protocols within your team. Use project management tools to allocate tasks and deadlines during working hours.
  2. Educate Your Clients: Inform clients about your commitment to the Right to Disconnect. Many design practices find themselves regularly driving towards unrealistic deadlines set by clients - Right to Disconnect may assist in helping set expectations regarding response times and availability to clients, ensuring more realistic project phases.
  3. Utilize Technology Wisely: Leverage tools that support asynchronous communication. Schedule emails to be sent during work hours and use project management platforms to track progress without constant check-ins.? We've all been in meetings that could have been an email - only have meetings that require it.
  4. Promote a Healthy Culture: Foster a workplace culture that respects personal time. Encourage team members to disconnect after hours and lead by example.?

By embracing the Right to Disconnect, we can foster a more sustainable, creative, and balanced approach to our work, ultimately enhancing the quality of our projects and the health of our industry.
