Unpaid leaves due to refusal to wear a mask is NOT constructive dismissal.

The Alberta Court of Queen's Bench: The court confirms that employees suffering consequences from refusing to comply with a thoughtfully drafted mask mandate policy do not amount to constructive dismissal.

Thoughtfully drafted policies make exceptions for individuals with protected human rights reasons for being unable to comply, particularly for confirmed medical reasons and authenticated religious reasons.
