Observing master negotiators in action is often as awe inspiring as a Cirque du Soleil performance. Skilled negotiators, whether they are negotiating corporate deals, release of hostages, or a job promotion, materialize brilliant viable solutions where none seemed to have existed. And they do so through a subtle interplay of human emotions and strategic positioning.

But you don't have to be a master negotiator in order to achieve favorable results. What you need is an understanding of where negotiation power comes from and how you can harness it.

Common Misconceptions

Negotiation power does not come from the following, which tend to be unsustainable strategies that eventually erode the possibility for a successful outcome:

  1. Aggression (e.g., launching a lawsuit or threatening one against a commercial partner to get a better deal)
  2. Deception (e.g., bluffing about your financials to a potential acquirer)
  3. Intimidation / Ultimatums (e.g., bluffing that you have another party with a term sheet ready to invest in your company when none exists)
  4. Past Performance (e.g., if you don't have true negotiation power, even having a startup with millions of users doesn't necessarily guarantee a favorable outcome, a sobering reality I faced with my first startup detailed in the opening chapter of my book Exit Path)
  5. Control (e.g., trying to dominate or control negotiating conversations leaves you blind to what the other side's motivations truly are)

These misconceptions lead negotiators to adopt strategies that often undermine their effectiveness and ability to achieve optimal or sustainable results. Successful negotiation is more about influence than authority, and as such not a byproduct of traditional power dynamics or a hierarchical approach. Success in negotiation requires a thoughtful balance of intelligence and empathy, understanding, and creating pathways towards mutual gain in light of real constraints and opportunities faced by each party.

To demystify negotiation and simplify it into actionable insights, I have distilled the essence of negotiation into a simple framework you can apply to any situation: Alternatives, Convergence, Trust.

Think of each component as a part of a three-legged platform on which you can stand to amp up your negotiation power.

Alternatives: The Power of Choice

Your strength in negotiation begins with the alternatives you have at your disposal. Alternatives give you the leverage to walk away when the terms don't meet your threshold of acceptability. But more than a fallback, a strong alternative amplifies your negotiating position, giving you confidence to push for better outcomes.

Convergence: Finding Common Ground

True negotiation mastery lies not in dominating the conversation, but in finding where interests align. Convergence is about seeking mutual benefits, understanding the other party's needs, and aligning them with your goals. This isn't just about compromise; it's about crafting solutions that are greater than the sum of their parts.

Trust: The Foundation of Every Deal

Trust is the bedrock upon which successful negotiations are built. It's about more than believing someone will follow through—it's about creating a rapport that encourages openness and collaboration. Building trust doesn't happen overnight, but with integrity and consistency, it's the key that unlocks long-term partnerships.

Thoroughly agree and can’t tell you how many times I’ve seen others take the positions you noted re: control, aggression, bluffing, etc. and it doesn’t usually turn out well and definitely rises to lack of credibility and trust. ACT is the way to go! Listening, finding common ground, understanding what is important to the other side and why (and understanding one’s own position and where there’s flexibility), showing kindness and respect will more times than not lead to a deal where both sides are happy.
