A Universal-Background-Check Law Would Not Violate the Second Amendment

In National Review, I argue that expanded background checks for gun purchases would not violate the Second Amendment, and not current doctrine on the Interstate Commerce Clause (though perhaps its original understanding). Debate should focus on whether the checks are effective in deterring mass shootings, not whether they are constitutional.

It depends, John. Heller left room for restrictions. But does it survive strict scrutiny? Will the evidence show its narrowly tailored and necessary?
