In New South Wales (NSW), the call for an Independent Victims Commissioner (IVC) and the inclusion of road crimes in the Charter of Victims' Rights resonates with urgency and necessity.

The establishment of an Independent Victims Commissioner would mark a pivotal step in advocating for the rights and interests of road trauma victims. This dedicated position would serve as a beacon of hope for those navigating the daunting complexities of insurance disputes, legal proceedings, and media intrusion in the aftermath of tragedy. By actively enforcing victims' rights, the IVC would ensure that no individual or family faces the daunting journey into the future alone.

At present, organisations like the Road Trauma Support Group NSW (RTSG) provide invaluable assistance to those grappling with the aftermath of road trauma. However, despite these commendable efforts, gaps persist in the accessibility and consistency of support pathways. Government-led legislative reforms and enhanced deterrence measures are imperative to stem the tide of road carnage and provide comprehensive support to those affected. One crucial aspect of this support is the provision of initial counselling hours for members of the RTSG community. The commitment to 22 hours of immediate counselling, independent of insurance claims, is a lifeline for families grappling with the profound impacts of road trauma. This initiative expedites the healing process and ensures equitable access to vital mental health services, particularly in regional and rural areas where such resources are scarce.

Moreover, the Charter of Victims' Rights Act demands a comprehensive overhaul to acknowledge road crime victims as legitimate victims of crime. Why is vehicular homicide treated as a lower form of homicide? Suffering and loss are no less significant than those affected by other criminal acts and warrant equal recognition and support. By closing existing gaps in financial assistance, mental health provisions, and legal guidance, we reaffirm our commitment to upholding the dignity and rights of all victims of road trauma.
