The Labour Market Impact Assessment (LMIA) is an important component of the Canadian immigration system, particularly for employers that want to hire foreign workers. With an LMIA, there is a determined fact that hiring foreign talent does not negatively impact the labour market of Canada. For both employers and prospective employees, it is very important to know the process of LMIA in Canada.

What is an LMIA?

An LMIA is an ESDC document that has to be used in assessing the impact of hiring a foreign worker into the Canadian labour market. In other words, it proves that there is no qualified Canadian or permanent resident available for the position. If the guaranteed LMIA is approved, then the employer is authorised to hire a foreign worker and apply for the work permit on their behalf.

Why is an LMIA Required?

The Process of LMIA in Canada

Employers must advertise the position and document all recruitment activities, including the job title, duties, wage, and work location. If no suitable candidates are found, employers can proceed with the application, which includes details of the job offer, evidence of recruitment efforts, and information on the impact on the labour market.

Employers can submit their LMIA application online or via mail, accompanied by the required fee. After submission, ESDC will review the application, which can range from a few weeks to several months. The processing time depends on the employer's recruitment efforts, labour market conditions, and the impact on Canadian workers.

Once a decision is made, employers will receive the LMIA approval or denial. If approved, the LMIA is typically valid for 6 months, and employers can provide the LMIA to the foreign worker, who can apply for a work permit. The process can take several months depending on the type of LMIA.

After Receiving a LMIA in Canada

Upon receiving the LMIA, the foreign worker must apply for a work permit. This would include, among others, an LMIA, a job offer letter from the employer, and other essentials. The worker is also further required to pass certain eligibility requirements such as medical exams and background checks.

Challenges & Consideration During LMIA in Canada

  • The LMIA is established to protect the Canadian labour market but is difficult for the employer in the recruitment process and time-consuming and costly. Even with proper documentation, there is no guarantee that the LMIA will be approved.

  • Not only do employers have to track the latest change in government rules and policies regarding LMIA applications, but the changes are continually being updated for immigration laws to fit demands within the labour market.
