Ukraine-EU law approximation: import/export procedures

Ukraine continues to implement EU law into its legislation. Another interesting update happened last week. The Ukrainian Parliament adopted a law which introduces changes to the Customs Code of Ukraine.?

In particular, it concerns the procedure of declaring the goods to the customs, which belong to one category of goods according to the Ukrainian classification of goods in external economic activity.

From now on this declaration procedure will be more simple. Indeed, goods that share similar characteristics can be declared under one classification code. They still have to be fully described in the customs declaration, but such simplification will help to minimise the number of administrative cases against the customs services.?

It is unbelievable how many cases there were because of using the wrong classification codes. Approximation of the Ukrainian Customs Code to the norms of the EU Customs Code will make the import/export trade more attractive and transparent.

Furthermore, on 06 July 2022 an Agreement between the European Union and Ukraine on the carriage of freight by road was signed. What does this agreement foresee?

  • Granting additional rights of transit and carriage of goods between the Parties to operators established in one of the Parties
  • Measures to facilitate the recognition of driver documents

Each Party shall exempt the holders of driver documents issued by the other Party from the requirement to hold an international driving permit.

This Agreement is valid until 30 June 2023. Therefore, conditions have been created for the EU-Ukraine trade to continue without disruptions.
