UCPMP Discussion: What has shaped the law concerning pharmaceutical marketing since the Supreme Court's recent decision?

Press release | Delhi | April 4, 2022

As Gwen Ifill quoted “Change comes from listening, learning, caring and conversation”.

A revelatory webinar for Pharma Marketing, Medico Marketing, Legal-Sales teams, and all concerned in the pharma sector was hosted by PharmaState Academy, a learning and development platform for the pharmaceutical industry. PharmaState.academy and the Institute of Medicine and Law have collaborated to provide a live interactive session on Pharma Marketing Law/Regulations/UCPMP with the topic "Changes in pharma marketing law after the Supreme Court's recent decision." The Institute of Medicine and Law (IML) offers medical law education, information, and services.

The webinar was hosted by Advocate Mahendra Kumar Bajpai, one of India's foremost authorities on medical laws. He is an Honorary Director of the Institute of Medicine and Law, as well as a Supreme Court lawyer. Advocate Bajpai is a well-known public speaker who is well-respected in both the legal and medical worlds. He is well-known in court for his strong arguments.

The session was kicked off by Dr. Swati Sinha & Vivek Hattangadi which garnered a huge number of attendees. Due to the speaker's and participants' frequent acknowledgments, time continued and extended for another one hour. Representatives from major pharmaceutical corporations were in attendance. With over 40 questions asked in the live session and eloquently answered by Adv Bajpai, the conversation gave in-depth knowledge to the attendees on the subject.

“Whatever you choose to do, leave tracks. That means don’t do it just for yourself. You will want to leave the world a little better for your having lived.” - once said Ruth Bader Ginsburg, Former Associate Supreme Court Justice of the United States.

The Hon'ble?Supreme Court issued a Notice dated 22.02.2022, under a writ of mandate to develop a Uniform Code of Pharmaceutical Marketing Practices to curb unethical pharmaceutical company practices.

By opening the session with "Law & ethics- the legal jargons have its own meaning. The never-ending debate of how law evolves from ethics and vice versa," Adv. Mahendrakumar Bajpai gave insight on The Indian Medical Council Act, 1956 (Professional conduct & Ethics), Regulations, 2002, and the pertinent acts and regulations.

The seminar was rich with knowledge and lively discourse, thanks to the firsthand occurrences of the Q&A round. A profound conversion brightens the discussion as Dr. Swati poses various issues. Adv. Mahendrakumar Bajpai correctly observed, "Traditional knowledge all throughout the world, three sorts of persons were forbidden from pursuing any trade at all: healer, teacher, and preacher."
