9:30am Division 1 Court of Appeals/Seattle:

Thida Chea v. Sofal Long: Chea appeals the trial court’s final divorce orders and argues we should vacate the court’s supplemental findings because the court had no authority to enter them under CR 60(a).? She also argues the court failed to consider the necessary statutory factors, improperly applied a presumption of equal residential time, and considered extrajudicial information when deciding the permanent parenting plan.? And she argues the court erred by distributing property in Cambodia that neither party owns and by failing to make a just and equitable property distribution.

State v. Ronnie Ater Jr.: Ater appeals his conviction of one count of possessing depictions of minors engaged in sexually explicit conduct in the first degree.??

Graham Contracting, Ltd. v. Pacific Pile & Marine LP: Pacific Pile & Marine sued its general contractor, Graham Contracting, for breach of contract stemming from a bridge restoration project.? Following trial, a jury concluded Graham breached the implied duty of good faith and fair dealing by not suing or pursuing WSDOT for Pacific Pile’s claim about extended use of the bridges.? The court awarded Pacific Pile attorney fees and costs, as well as prejudgment interest.? Graham appeals.?

Milagros Moniz v. King County Public Hospital District No. 1: Moniz visited Valley Medical Center's emergency room and his primary care provider at the Kent Clinic (collectively Valley) in May and June of 2016 and later sued Valley for professional negligence.? Valley moved for summary judgment based on the statute of limitations and Moniz argued the statute had been tolled.? The trial court denied Valley's motion for summary judgment but certified the order to this court for review.

Nasra Elmi et ano v. Aesthetic Rejuvenation Spa, PLLC et ano: On appeal of a jury verdict in favor of plaintiffs, Aesthetic Rejuvenation Spa and Kristine Brecht argue the trial court erred by admitting certain evidence at trial and by denying their motion for mistrial, motion for directed verdict, and motion for a new trial.
