Jodi Van, et ano, v. City of Burien, case # 850776 - Jodi Van obtained a shoreline exemption to repair a dilapidated garage and deck. To comply with building codes, Van altered her plan to include replacement of the existing structures. The City of Burien initially issued a building permit but subsequently suspended it because the project exceeded the shoreline exemption. A hearing examiner upheld the City’s actions. In this petition, Van argues that to suspend her permit, the City was required to file a timely petition under the Land Use Petition Act, chapter 36.70C RCW.
