Is it true that all retained EU law will be abolished by the end of 2023?
Not quite, however the Retained EU Law (Revocation and Reform) Bill 2022-23 was introduced to the House of Commons yesterday, 22 September 2022. The Bill makes provision for significant changes to the current status and operation of retained EU law, and is likely to be one of the most important pieces of employment legislation that we've seen since the introduction of discrimination and unfair dismissal laws in the 1970s.
The Bill will automatically repeal any retained EU law (including statutory instruments) so that it expires on 31 December 2023, unless specific legislation is introduced to retain it. The date of 31 December 2023 can be extended to 31 December 2026, so it is likely to take some time.
What does this mean for employment law in the UK?
The likelihood is that we will be seeing some changes in relation to TUPE, the Working Time Regulations (in particular paid holiday and the maximum 48-hour working week), and, of course, the not so popular Agency Worker Regulations.?
At the current time we don't know what employment rights will stay and what might drift away, but its certainly something to look out for over the next 15 months.
