Triumph Over Adversity: Defending a Charitable School's Right to Education in the Supreme Court

I had the honour of representing a charitable school from Kolkata in a challenging legal battle that eventually found its resolution in the Supreme Court. The school faced imminent eviction after their appeals were dismissed in default, leading us to file a Special Leave Petition (SLP) with a significant delay of over 1000 days.

From the outset, the odds seemed stacked against us. On our first day in the Supreme Court, while the judges appeared sympathetic, they declined our request for a stay due to the prolonged delay in filing. It was a setback, dampening our initial optimism as the opposing party relentlessly pursued eviction.

Undeterred, we pressed on with unwavering persistence, knowing that justice, though delayed, could still prevail. The journey was arduous, marked by moments of uncertainty and waiting, but our belief in the righteousness of our cause kept us steadfast.

Finally, just recently, after what felt like an eternity of anticipation, the Supreme Court reversed the dismissal order. They remanded the appeal back to the High Court, granting us a renewed opportunity to argue our case. It was a moment of triumph that filled me with profound gratitude and relief.

What made this victory even more meaningful was the heartfelt support and joy from the school board. Each member reached out to me personally, expressing their gratitude and appreciation. Their unwavering faith and unity throughout the ordeal underscored the power of collective determination in pursuit of justice.

As I reflect on this experience, I am reminded of the resilience and fortitude exhibited by everyone involved. It reaffirms my commitment to advocating for justice and fairness, no matter the challenges faced along the way.
